  • (b) With regard to economic resources and assets other than bank deposits, the Attorney-General has powers to impound all movable or immovable assets. On the basis of these powers, all public or private State enterprises are prohibited from disposing from such funds, resources and assets by way of sale, donation, assignment or any other form of disposal until such time as a judicial decision is handed down regarding them in accordance with the law.

  • The Act stipulates that the competent authority may apply the following protective measures: a) order the aggressor to leave the home and, in the event of resistance, have the aggressor forcefully removed by the police; b) allocate a new communal home for the victim, to protect her from future attacks; order that the home be broken into if the physical, sexual, patrimonial, or psychological integrity of any of the inhabitants is at grave risk; d) forbid weapons to be introduced to, or kept in the home, when they are used to intimidate, threaten, or cause harm; e) confiscate the weapons of the alleged aggressor; f) suspend or ban the aggressor from involvement in caring for, raising, or educating the minor children; g) prohibit the alleged aggressor from accessing the home, workplace, or place of study of the victim, either temporarily or permanently; h) impose a maintenance payment, in accordance with the Maintenance Act; i) order the seizure of fixed assets belonging to the family nucleus and order that the victim may have use of household items; j) order the alleged aggressor to refrain from interfering with the use and enjoyment of the working tools of the victim; k) order the aggressor to pay damages in compensation for harm done to the victim or to the property essential to the victim's everyday life; l) issue a police protection order under which the victim may seek help from the local police authorities in the event of a threat outside the home.
    وينص هـــذا القانون على أن بإمكان السلطة المختصة تطبيق تدابير الحماية التالية: (أ) إلزام المعتدي بالخروج من المنزل، فإذا قاوم تولت الشرطة إخراجه؛ (ب) توفير مسكن غير المسكن المشترك للمعتدى عليه ليحتمي به من أي اعتداء في المستقبل؛ (ج) الأمر بمداهمة المنزل عندما يؤدي العنف المنزلي إلى تهديد خطير للسلامة البدنية لأي من سكانه أو سلامته الجنسية أو المالية أو النفسية؛ (د) منع إدخال أسلحة إلى المسكن أو الاحتفاظ بها فيه عند استخدامها للترويع أو التهديد أو الإيذاء؛ (هـ) نزع السلاح الموجود لدى المعتدي المزعوم؛ (و) كفّ يد المعتدي أو منعه من حضانة وتنشئة وتربية الأطفال القصّر؛ (ز) منع المعتدي المزعوم من الوصول إلى مسكن المعتدى عليه أو مكان عمله أو دراسته بشكل مؤقت أو دائم؛ (ح) فرض نفقة بمقتضى قانون النفقة؛ (ط) ترتيب الحجز الاحتياطي على الأموال المنقولة للأسرة النواة واستخدام المعتدى عليه لأثاث المسكن؛ (ي) منع المعتدي المزعوم من التدخل في استخدام أدوات عمل المعتدى عليه والانتفاع بها؛ (ك) إلزام المعتدي بالتعويض النقــــدي عن الأضرار التي لحقت بالمعتـــــدى عليه أو بالممتلكـــات اللازمة لحياته العادية؛ (ل) إصدار أمر حماية من شرطة النجدة لتمكين المعتدى عليه من اللجوء إلى الشرطة القريبة منه إذا تعرض للخطر بعيدا عن مسكنه.
